Photography & Media Release Agreement

Digital Homes Media

(North Carolina)

By booking services with Digital Homes Media, the Client (“Agent”) acknowledges and agrees to the following:

1. Authority to Grant Access & Consent

The Agent represents and warrants that they have obtained full authorization from the property owner (“Seller”) to allow Digital Homes Media to photograph and/or record the interior and exterior of the property for real estate marketing purposes, in accordance with common practices in the State of North Carolina.

2. Permitted Use of Media

The Agent grants Digital Homes Media the right to capture, edit, reproduce, publish, and display the media for lawful purposes including, but not limited to: MLS and IDX platforms; real estate marketing and advertising; website, portfolio, and promotional materials; and social media and digital marketing. No additional compensation shall be due beyond the agreed service fee.

3. Privacy & Occupancy

Digital Homes Media does not intentionally photograph individuals. The Agent and/or Seller are responsible for ensuring the property is prepared for photography, including the removal or concealment of personal or sensitive items prior to the scheduled appointment.

4. Ownership & Licensing

All photographs, videos, and media content produced remain the exclusive intellectual property of Digital Homes Media. The Agent is granted a non-exclusive, non-transferable license to use the delivered media solely for marketing the photographed property. Resale, transfer, or reuse of the media for other properties or third parties is prohibited without written consent.

5. Limitation of Liability & Indemnification

The Agent agrees to indemnify and hold harmless Digital Homes Media from any claims, disputes, or liabilities arising from the Agent’s failure to obtain proper authorization from the property owner or occupants.

6. Governing Law

This agreement shall be governed and interpreted in accordance with the laws of the State of North Carolina.
